1. Scope and applicability

Triton is committed to protecting your privacy. This Privacy Policy (“Policy”) explains our practices regarding the collection, use, disclosure, and protection of information that is collected through our mobile app and our website (collectively, our “Service”), owned and operated by Triton Valves Limited (“Triton”“Company”“we”“us” or “our”), as well as your choices regarding the collection and use of information.

This Policy is in accordance with the provisions of the Information Technology (Reasonable Security Practices and Procedure and Sensitive Personal Data or Information) Rules, 2011 (“Rules”). The Rules apply to a body corporate or any person located within India. Providers of information, as described in the Rules, are those natural persons who provide sensitive personal data or information to a body corporate.

By using our mobile app and website, and our Service, you hereby agree that you:

- are using our mobile app or website for lawful purposes; and

- consent to the information collection, use and retention practices described in this Policy.

2. Definitions

2.1 Data:  Means a representation of information, knowledge, facts, concepts or instructions which are being prepared or have been prepared in a formalised manner, and is intended to be processed, is being processed or has been processed in a computer system or computer network, and may be in any form (including computer printouts magnetic or optical storage media, punched cards, punched tapes) or stored internally in the memory of the computer.

Information: Includes data, text, images, codes, computer programmes, software and databases or micro film or computer generated micro fiche.

Personal Data or Information: means such personal information which consists of information relating to:

  • Password (“password” means a secret word or phrase or code or passphrase or secret key, or encryption or decryption keys that one uses to gain admittance or access to Information);

  • Any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

3.1  We collect the following types of information about you:

3.1.1  Registration and Profile Information. When you create an account on our mobile app or website, we collect your Personal Information for sellers or businesses, specifically the name of your organisation/ business, your business category and certain information about your sales or transaction volume. In some cases, we may also ask you to send us additional information or to answer additional questions to help us verify your information. The Information you provide must be true, complete, current and accurate. We do not bear any liability for the consequences if you provide false, incomplete or incorrect Information. You represent and warrant that you are legally and fully entitled to use any debit card, credit card, bank or any other mode that you may use to make purchases of the products by using our Services. We shall not be held responsible in case you don’t have sufficient funds or authorised access to use such payment modes as mentioned hereinabove to make purchases on our Services.

3.2  Information we receive about you from others:

3.2.2 Information we collect automatically through the use of technology:  When you visit our website or use our mobile app, we may collect certain Information about your computer or device through technology such as cookies, web beacons, log files, or other tracking/recordingtools. The Information we collect through the use of tracking technologies includes, but is not limited to, IP address, browser Information, referring/exit pages and URLs, click stream data and Information about how you interact with links on the website, mobile app, or Service, domain names, landing pages, page views, cookie data that allows us to uniquely identify your browser and track your browsing behaviour on our site, mobile device type, mobile device IDs or other persistent identifiers, and location data collected from your mobile device. Some or all of this data may be combined with other personally identifying Information described above. When you access our Service by or through a mobile device, we may receive or collect and store a unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers (“IDFA”).

3.3 Modifying Your Account Information and Settings: You may modify your account Information, update or amend your Personal Information, or change your password at any time by logging in to your account at any given point of time. As noted above, you may not opt out of Service-related communications (e.g., account verification, SMS regarding order status). 4 Use of Data/ Sharing Information

4.1  Kindly note that we use the Information to:

  •  Remember Personal Data or Information so that you will not have to re-enter it during your visit or the next time you visit the site or mobile app.
  •  Diagnose or fix technology problems reported by our Users or engineers that are associated with certain IP addresses or User IDs, and automatically update       our mobile application on your system and related devices.


4.2   Except as described above in Section 4.2 and 4.3, we will not disclose Personal Information to third parties (including law enforcement, other government entity, or civil litigant; excluding our subcontractors) unless required to do so by law or subpoena or if in our sole discretion, we determine it is necessary to:

  • conform to the law, comply with legal process, or investigate, prevent, or take action regarding suspected or actual illegal activities; 
  • to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any claims or allegations, or to protect the security or integrity of our site; and/or 
  • to exercise or protect the rights, property, or personal safety of Triton, our Users or others.

4.3  However please note that as per the applicable laws, if we are required to maintain records of certain Information that is Personal Information, then the same shall be used and disclosed only to the extent required under the law.

5Protection of Data/ Information

5.1 Triton cares about the security of your Data or Information and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all Information we collect and that we share with our service providers. However, no security system is impenetrable and we cannot guarantee hundred percent (100%) security of our systems. In the event that any Information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose Information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

5.2  We are not liable and cannot be held liable for any breach of security or for any actions of any third parties that receive such Personal Information.

6. Your Consent

6.1  By using our website and/or our mobile app, and/ or by providing your information, you consent to the collection and use of the information you disclose on our website and/or our mobile app in accordance with this Privacy Policy, including, but not limited to your consent for sharing your information as per this privacy policy.

6.2  If we decide to change this Privacy Policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

8. Governing Law and Dispute Resolution

This Policy shall be governed by and construed in accordance with the laws of India. All disputes in relation to this Policy shall be adjudicated exclusively before a competent court in Bengaluru only.

9. Changes to Our Privacy Policy

Triton may, in its sole discretion, modify or update this Privacy Policy from time to time, and hence, you should review this page periodically. When we change the policy, we will update the ‘last modified’ date at the top of this page. If there are material changes to this Privacy Policy or in how Triton will use your Personal Data or Information, we will notify you, either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification.
